A child who suffered brain damage has received over £6m following a court hearing involving Dale & Newbery’s clinical negligence team.
The child who is now 15 suffered from cerebral palsy after a failure by a Greater London Hospital to diagnose meningitis when he was just a few months old.
Our clinical negligence team, which has a strong record of such cases, was instructed on the child’s behalf some years later and, at that stage, the NHS Trust defended the proceedings.
However, shortly before trial, the issue of liability was compromised on favourable terms with the Court’s approval and the damages payable for the child’s life changing injuries and losses were finally approved by the High Court a few weeks ago.
Clinical negligence cases of this nature are complex and this was another testing case, which required input from a variety of highly qualified experts, not only as a result of the child’s grievous injuries but because of his limited life expectancy.
We are pleased with the outcome and the compensation recovered for the child has enabled him and his family to relocate to adapted accommodation. Arrangements are also in place for round the clock care and for a host of domiciliary treatment including physiotherapy, occupational therapy and speech and language therapy.
The settlement of the claim involved a payment of a substantial capital sum and annual periodical payments which will continue throughout the child’s lifetime to ensure there will always be sufficient funds available to provide for his care needs.
